Nail Technicians' Professional License Defense

You're serious about your job. You're committed to helping others look and feel good about themselves. Your hard work paid off when you became a nail technician. Training took hundreds of hours. You likely had to pass a licensing exam as well. A complaint and or investigation by the Virginia Board of Barbers and Cosmetology can be unsettling.
You don't have to handle complaints and investigations alone. When you need them, Attorney Tori Bramble and her professional license defense firm are ready to square off with the Board and fight for your rights.

Keeping Your Nail Tech License is Important

The nail technician's license is crucial to your livelihood, your ability to support yourself and your family. Having your nail tech license means you're officially allowed to practice using your talents.
The stakes are much bigger than whether or not the Virginia cosmetology board will let you keep working as a nail tech. It's your professional reputation and your ethics. Don't let complaints go unchallenged. Get the best professional help you can find to protect yourself. Attorney Tori Bramble and her professional license defense team at LicenseSure can help.

What Could Go Wrong?

You're vulnerable to complaints anytime you provide a personal service, and any one of those complaints could lead to the Virginia Board of Barbers and Cosmetology getting involved and starting an investigation. Common complaints are:
• Neglecting sanitary practices like cleaning linens and disinfecting equipment between clients

• Alcohol or drug use while practicing

• Crossing professional boundaries in any way with clients

• Using unlicensed employees to do licensed jobs

• Doing something outside the scope of your nail tech license

Everyone makes mistakes, and you shouldn't lose your license just because you've received a complaint. But you don't even have to do anything wrong to get into trouble. You can get complaints from anyone, including unhappy customers, nail shop competitors, and even disgruntled employees.
You should never handle a complaint yourself. In this social media age, even a minor complaint can get out of hand quickly. We work hand in hand with you to come up with solutions to minimize or eliminate any negative stain on your nail tech license. We're here to help you and ready to do whatever it takes to make the disciplinary process as easy as possible.

What Can I Expect After A Complaint?

Now that you know the potential problems, what happens when you get a complaint in the mail? The process usually goes like this:
• The most common way a case starts is when someone complains. A co-worker, colleague, customer, or the Board can file a complaint if you fail a regular inspection.

• The Board starts an investigation if it thinks the complaint is legitimate and it will ask you questions during that investigation. Also, the Board could interview anyone associated with the case, including your supervisors and coworkers.

• The full barber and cosmetology board gets to hear investigators' findings. If the board should find you responsible for violating a Board rule, or if you admit to a violation, then the Board may offer you the chance to sign a “Consent Order.” This Order summarizes your charges, explains Board findings, and determines what you'll have to pay. Consent orders can sometimes be private, but the majority of the time, they're made public to ensure the public is protected.

• If you disagree with the board's finding, you can challenge it. At a board hearing, you can defend yourself and call witnesses on you behalf and to counter any witness the Board brings. The most important thing is that you have the right to an attorney, someone to represent you.

Tori D. Bramble and her team will be by your side all the way, from the moment a complaint is filed through any investigation and hearing. How can they help?

• Look for any holes in the complaint and make sure you understand it

• Help you build a case strategy, find witnesses, collect evidence, and get ready for court

• Attend all Board investigative meetings

• Stay on top of case developments and keep you updated on the Board's evidence

• Write an official response to the accusation against you and see if you can make it right with the Board.

• Put pressure on the board to drop the charges

• At any hearing, we'll represent you and fight for your rights.

• Appeal if needed

Even though Joseph D. Lento and his team can help you with anything, you're better off acting sooner rather than later. It's far easier to defend yourself at the complaint stage than it is at the appeal stage. Once an investigator or decision-maker decides you're guilty, it's hard to convince them otherwise. Waiting until after the board hearing could already be too late.
